The Professor Nedley Series
Possible New Style Moveaway Orders
May, 2006
The Family Law Institute presented a program on moveaways and as an exercise challenged the judges present with coming up with useful ideas on orders that would facilitate communication in the event that a moveaway was granted. Obviously the ideas have not been exhuasted, nor have the judges. Ideas are wide open. If you have some newer, better or fresher ideas mail 'em in to nedley@san.rr.com or Patricia.Garcia@sdcourt.ca.gov.
Low Tech, Low Cost:
1. The non-moving parent shall provide the moving parent (or the child if old enough) before he/she moves, a stack of self-addressed stamped envelopes for the child to send homework, grades, drawings, writings, etc., to the non-moving parent. This provision is at the child’s discretion.
2. The moving parent shall mail to the non-moving parent on a bi-weekly basis all homework, grades, parent-teacher conference documents, school newsletters, sports fliers, and any other writings related to the child, as well as evidence of appointments with health care professionals, including psychological, vision and dental care.
Mid-level tech and Modest Cost:
3. To maintain frequent contact/communication between the child/children and the non-moving parent, the moving parent shall provide the child/children with a cell phone [with camera and picture taking capability?] for the purpose of enabling communication between the child/children and the non-moving parent. The moving parent shall provide the non-moving parent with the cell phone number within 72 hours of the court's order and the name of the service being used so that the non-moving parent, at his/her discretion, may obtain the same service in order to qualify for unlimited calls/minutes.
4. To maintain frequent contact/communication between the child/children and the non-moving parent, the parents shall obtain fax machines and dedicated telephone lines within 14 days of the court's order. As well, the parents shall provide to the other the fax number within 14 days of the court's order. The moving parent shall make sure the child/children faxes to the non-moving parent all homework, grades, parent-teacher conference documents, school newsletters, sports fliers and any other writings on a weekly basis. The moving parent shall fax to the non-moving parent all evidence of appointments with health care professionals, including psychological, vision and dental care.
Cost Not an Issue
If the parents have computers and/or money is not a major obstacle:
5. To maintain frequent contact/communication between the child/children and the non-moving parent, the moving parent shall provide the child/children with a computer system and a web camera, as well as Instant Messaging capability. The non-moving parent shall provide the same for him/herself. Within 14 days of the court’s order, the parents shall exchange email [and Instant Messaging?] addresses.
6. Moving parent/non-moving parent shall provide ____________ with a video camera or throwaway digital camera to enable pictures of various activities in which the children participate.
7. Moving parent shall immediately arrange for medical and school information to be automatically sent by fax or email directly to non-moving parent. The non-moving parent shall have full medical and educational record access.
8. Moving party to pay all/1/2/none ______ % of costs of these items.
